How do I serve a rent increase notice?

ForLandlordsProperty managers

Who can do this

Landlord, Organization admin, Organization members with Edit Leases (Serve Notices alone isn't enough).

Where to find it

How will you serve it? in the composer, Leases → <lease> → Notices → <row> → Serve, or Key details → Continue to deliver.

Steps

  1. Choose Email it through Kera and press Send notice, or I delivered it myself → method → Date served → optional proof → Record service (see "Serving a notice").

What happens next

Done reads "New rent $<new> from <date>", the service line and the deemed-received date. The Key details badge becomes scheduled. For a lease with online payments, Kera reprices the tenant's rent schedule from the effective date. Tenants are emailed "Notice of rent increase · effective <date>" and see the increase on their lease.

Good to know

Manitoba: after serving, Kera adds a High priority compliance task "Send a copy of the rent increase notice to the Residential Tenancies Branch", due 14 days after the date served.

Troubleshooting

  1. Ontario, Manitoba and Alberta, served too late for the date on the notice: "Served on this date, the notice is too short for the effective date it states, and in this province that makes it void. The notice was not served. Edit the increase to a date on or after <date>, then prepare and sign the notice again." Nothing is sent or recorded.
  2. British Columbia and Saskatchewan, served late: Kera serves it and moves the start date: "The notice was served later than planned, so the new rent starts on <date>, the earliest date the law allows."
  3. A signed notice that now breaks a rule (for example another increase was served since): refused with the rule and "The notice was not served. Edit the increase from the lease, then prepare and sign the notice again."
