What is a pre-termination notice, and how do I give one?
ForLandlordsProperty managers
Who can do this
Landlord, Organization admin, Organization members with Terminate Leases and Prepare Notices.
Where to find it
Reasons that need a written notice first ask, after Continue, a question such as Did you give a written notice to remedy? (or breach letter, written demand for utilities, written warning, notice of complaint, notice of contravention, notice to comply, notice to correct).
Steps
- Pick one:
- Use the <notice> you served on <date>: reuses one served through Kera. It can only be chosen once the time to fix has passed ("You can give the <form> from <date>.").
- Send one through Kera: "Kera writes the <notice>. Come back for the <form> once the time to fix it has passed." Enter What needs to be fixed (or utilities owing) and Date to fix it by (or Pay it by).
- I gave one outside Kera: enter the date you gave it, How you gave it (only the province's methods), Date they had to fix it by, and optionally a copy.
- Not needed: <reason>: when the law doesn't require one for that cause.
- For Send one through Kera: Continue → Review → Create notice → sign → serve.
What happens next
Done reads "If it isn't fixed by <date>, come back to give the <form>. Kera adds a task for the day after." The task "<Notice>: the time to fix it has passed. Give the <form> if it wasn't fixed" is due the day after. When you return to End lease with the same reason, the reuse option appears first. For "I gave one outside Kera", Kera records that notice as served on the lease and then creates the termination notice relying on it.
Good to know
Newfoundland and Labrador's notice to comply is the official Landlord's Request for Repairs form, one item per line, up to 5. British Columbia's breach letter and utility demand, PEI's written warning, New Brunswick's notice of complaint and Yukon's notice to correct work the same way. Yukon's notice of unpaid rent is upload only.
Troubleshooting
- "Give the tenant time to fix it: pick a later date." for a fix-by date today or earlier.
- Serving it by mail with too little time: "Served today this way, the tenant gets it on <date> and needs until at least <date> to fix it..."
- "Enter today or an earlier date." for a future "given" date.
- "Saskatchewan counts a mailed or emailed notice only if it was also posted on the door. If it wasn't, give it again."
- "The time to fix it hasn't passed. You can give the <form> from <date>."
