How do I give an N5 for damage, interference or overcrowding (Ontario)?
ForLandlordsProperty managers
Who can do this
Landlord, Organization admin, Organization members with Terminate Leases and Prepare Notices.
Where to find it
End lease → Damage or interfering with others.
Steps
- Under Which reasons apply?, tick any of Interfering with the landlord's or other tenants' reasonable enjoyment, Wilful or negligent damage, Too many people living in the unit.
- Tick "This is a second N5..." only if you already gave this tenant an N5 that gave them 7 days to correct the problem and this happened more than 7 days but less than 6 months later (an N5 served outside Kera counts).
- For damage, choose What will the tenant pay for? (Repair the damage or Replace it (repair isn't reasonable)) and enter the estimated cost. For overcrowding, enter Maximum number of people allowed to live in the unit and name the by-law in the details.
- Enter Date it happened and What happened.
- Create, sign and serve.
What happens next
The termination date is 20 days after deemed receipt (14 for a second N5). Done notes "The first N5 in 6 months is voidable if the tenant stops the conduct (or repairs the damage) within 7 days."
Troubleshooting
"Enter the estimated cost" / "Enter the maximum number of people allowed" when those are blank.
